Terms of Service

These Terms of Service (“Terms”) govern your access to and use of services provided by NAMH Global Ltd (“NAMH”, “we”, “our”, or “us”), a company registered in Saint Lucia (Company No. 2024-00372), with registered office in Saint Lucia. NAMH Global Ltd is the broker entity that holds client funds and executes trades under this Agreement.

Residents of the United Arab Emirates are served by our UAE affiliate, NAMH Global Financial Consultancy L.L.C, a UAE-mainland company registered in Dubai with offices at 2202, Al Moosa Tower 2, Sheikh Zayed Road, Dubai, UAE. The UAE entity acts solely as a local liaison; the contractual broker for trade execution, custody of client funds and account terms remains NAMH Global Ltd (Saint Lucia).

By opening an account, depositing funds, or placing a trade through NAMH, you enter into a binding legal agreement with us based on these Terms, our Privacy Policy, and our Risk Warning. If you do not agree with any part of these Terms, you must not use our services.

You may open an account with NAMH only if you meet all of the following:

• You are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher).
• You have the legal capacity to enter into binding contracts.
• You are not a resident or citizen of a restricted jurisdiction (see Section 12).
• You have completed our KYC (Know Your Customer) verification process.
• You are not trading on behalf of a third party without prior written authorization.

NAMH reserves the right to reject account applications without providing a reason. We may also request additional documentation at any time to comply with AML/CTF obligations.

NAMH provides online trading services for retail clients, including access to:

• Over-the-counter (OTC) contracts for difference (CFDs) on forex, commodities, indices, cryptocurrencies, and equities.
• The MetaTrader 5 (MT5) trading platform across desktop, web, and mobile.
• Partner programmes (Introducing Broker, Affiliate) under separate agreements.
• Educational resources, market analysis, and trading tools for informational purposes only.

Nature of CFDs

A CFD is a derivative product whose value is derived from an underlying market. You do not own the underlying asset. CFDs are leveraged instruments that amplify both profits and losses. See our Risk Warning for full details.

All trades are executed under the conditions published on our website at the time of execution, including:

• Spreads: variable, based on live tier-1 liquidity.
• Commissions: where applicable (primarily ECN accounts), as disclosed in the account specification.
• Leverage: up to the maximum permitted for your account type and the instrument.
• Swap / rollover: charged or credited daily at 22:00 UTC; triple swap applies Wednesday.
• Slippage: orders may fill at a different price than requested during fast markets.

NAMH does not guarantee execution at any specific price, particularly during high volatility, news releases, or low-liquidity periods.

Client funds are held in segregated accountsat top-tier banking institutions, legally distinct from NAMH's operational accounts. Segregation means:

• Client funds cannot be used to meet NAMH's operational expenses.
• Client funds are not available to NAMH's creditors in the event of insolvency.
• Daily reconciliation ensures records match actual bank balances.

Negative Balance Protection applies to all retail accounts. You cannot lose more than your deposited capital regardless of market gaps or slippage.

Deposits and withdrawals are processed through the payment methods published on our Funding page. NAMH charges no deposit or withdrawal fees; third-party gateway fees may apply.

Source of funds

Funds deposited must originate from a payment method in your own name. Third-party deposits are not permitted and will be returned to the source.

Withdrawal routing

Withdrawals follow AML source-of-funds rules — funds deposited via card must be withdrawn to the same card up to the deposit amount; profits may be withdrawn via bank wire or verified crypto address.

The following activities are strictly prohibited on NAMH accounts:

• Market abuse, including arbitrage against stale pricing, latency exploitation, or price manipulation.
• Use of account for money laundering, terrorist financing, or any illegal purpose.
• Collusion between accounts to generate artificial volume or extract bonus funds.
• Opening multiple accounts to circumvent account-level limits or restrictions.
• Sharing account credentials with third parties.
• Use of the platform to trade in restricted jurisdictions.

Fees are disclosed on our website and in the account specification document. Current fees include:

• Spreads: variable, from 0.0 pips (ECN) or 1.2 pips (Standard) on EUR/USD.
• Commissions (ECN): $5 per standard lot round-turn.
• Swap / rollover: as published in MT5 instrument specs.
• Dormancy fee: $10/month after 12 consecutive months of inactivity.
• Currency conversion: ~0.5% for cross-currency deposits.

NAMH reserves the right to change fees with 30 days' prior notice.

To the fullest extent permitted by applicable law, NAMH shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our services, including but not limited to loss of profits, loss of data, or business interruption.

Our total liability for any claim shall not exceed the total fees and commissions paid by you to NAMH in the 12 months preceding the event giving rise to the claim.

This limitation does not apply to losses caused by NAMH's gross negligence, fraud, or wilful misconduct.

You may close your account at any time by submitting a request through the client portal. NAMH may also terminate your account with or without cause upon reasonable notice, except where:

• Termination is required by law or regulator.
• You have breached these Terms.
• Your account shows patterns of abuse, fraud, or illegal activity.

On termination, open positions will be closed at prevailing market prices, and remaining balance will be returned via the verified payment method. Records are retained for 5–7 years post-closure per regulatory requirements.

These Terms are governed by the laws of Saint Lucia. Any dispute arising from these Terms or your use of our services shall first be addressed through our internal complaints procedure (contact complaints@namhglobal.com).

If a dispute cannot be resolved internally within 30 days, the matter shall be submitted to arbitration in Saint Lucia under the rules of the Eastern Caribbean Supreme Court, with English as the arbitration language. The arbitrator's decision shall be final and binding.

NAMH does not offer services to residents or citizens of the following jurisdictions:

• United States of America
• India
• Cuba
• Iraq
• Myanmar
• North Korea (DPRK)
• Sudan

Additional restrictions may apply under international sanctions regimes or local regulatory changes. It is your responsibility to ensure that using NAMH services is lawful in your jurisdiction.

NAMH may amend these Terms at any time by posting an updated version on our website. Material changes will be notified to account holders by email at least 14 days before taking effect. Continued use of services after the effective date constitutes acceptance of the updated Terms.

Historical versions of these Terms are retained in our compliance archive and available on request.
